LOCKWOOD, J. Jimmie Hunter, hereinafter called defendant, was convicted of the crime of assault with intent to commit robbery. After the usual motion for new trial was overruled, the court rendered judgment that he was guilty, but suspended the pronouncing of sentence for a period of seven years, and released the defendant from custody. Notwithstanding the fact that he was no incarcerated, the defendant has appealed to this court for a review of his case.
